Terms of Service

These terms are an agreement between you and Pointed Designs LLC ("Cosplayed", "we"). By creating an account or using the Cosplayed iOS app you agree to them. If you don't agree, don't use the app. Contact: support@cosplayedapp.com.

1. What Cosplayed is

Cosplayed is a convention calendar and a peer-to-peer marketplace where cosplayers buy, sell, and commission costumes, props, wigs, and related items. Sales are between buyers and sellers; Cosplayed is the platform, not a party to the sale. We facilitate payment, shipping labels, and problem resolution.

2. Accounts

You must provide accurate information, keep your credentials secure, and be at least 13 to use the app; to buy or sell you must be old enough to form a binding contract or have a parent or guardian's permission. One person per account. You are responsible for activity under your account. You can delete your account in the app at any time (see the Privacy Policy for what deletion removes and retains).

3. Content rules (zero tolerance)

You agree not to post content or engage in conduct that includes: harassment, hate, or threats; sexually explicit content; scams or fraud; counterfeit, stolen, recalled, or otherwise prohibited items; listings that misrepresent what ships; spam; or anything illegal. We may remove content, cancel listings, and suspend or permanently disable accounts at our discretion, with or without notice. Report abusive content or users with the in-app report buttons; blocked users cannot message you.

4. Buying

Prices are set by sellers. At checkout you pay the item price plus shipping and applicable tax. Your payment is held by the platform and is not released to the seller until you confirm delivery or the confirmation window passes. If something is wrong with an order, report it in the app within 72 hours of delivery ("Something's wrong"); a moderator will decide the outcome, which can include a full or partial refund. Card disputes filed with your bank are handled through Stripe's dispute process.

5. Selling

Sellers must complete identity verification and payout onboarding with our payment partner, Stripe. You must accurately describe items, ship promptly with the label or tracking recorded in the app, and honor the sale price. Cosplayed's fee is 12.5% of the sale price, deducted before payout; shipping is paid by the buyer. Payouts release after delivery is confirmed and any open problem reports are resolved. You are responsible for taxes on your sales; Stripe provides applicable tax forms.

6. Commissions

Commission listings let makers take custom work. Accepting a quote reserves a slot and fixes the agreed scope and price; payment for commissions is currently arranged between the parties and the platform fee applies to payments made through the app when in-app commission payment ships. Makers must honestly represent their skills, timelines, and revision terms.

7. Shipping and risk

Shipping labels are provided through Shippo with rates from the carriers. Flat-rate estimates or live carrier rates are shown before purchase. The seller is responsible for packing items adequately; carrier loss or damage is handled through the problem-report process.

8. Convention listings

Convention information is community-submitted and moderated. We don't guarantee accuracy of dates, venues, or details — always confirm with the convention itself.

9. Platform license and your content

You keep ownership of the content you post. You grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute it as needed to operate the service. Don't post content you don't have rights to. Character costumes and fan works are posted at your own responsibility with respect to third-party rights.

10. Disclaimers and liability

The service is provided "as is". To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, and our total liability for any claim relating to the service is limited to the greater of $100 or the fees you paid us in the twelve months before the claim. We are not liable for the conduct of buyers, sellers, or makers, though we provide the moderation and problem-resolution tools described above.

11. Changes and termination

We may update these terms; material changes will be announced in the app, and continued use after a change is acceptance. We may suspend or terminate accounts that violate these terms. Sections that by their nature should survive termination (fees owed, licenses for completed transactions, disclaimers, liability limits) survive.

12. Governing law

These terms are governed by the laws of the State of Florida, USA, excluding its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.
